Terms of Service

1. Acceptance of these terms

By creating an account or using Product Assessment, you agree to these terms. If you are using it on behalf of an organization, you confirm you have the authority to agree on that organization’s behalf.

2. What the service is

Product Assessment is an adaptive interview about product management decisions you have made, producing an evidence-based report on your demonstrated strengths, gaps, and readiness for the next level. It is built to inform a coaching, hiring, promotion, or development conversation -- it does not make that decision for you. See /methodology for how scores are derived and /trust for what it can and cannot conclude.

3. Your account

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You must be old enough in your jurisdiction to enter into these terms. One account is for one individual -- it should not be shared.

4. Acceptable use

You agree not to:

• Misrepresent your identity or provide answers on someone else’s behalf
• Attempt to extract, reverse-engineer, or systematically probe the assessment rubric or model prompts
• Upload documents containing malicious code or content you don’t have the right to share
• Interfere with the service’s normal operation, including attempting to bypass rate limits or usage caps
• Use the service to build a competing product

5. Your content and our license to use it

You own what you write during your interview and any documents you upload. You grant Product Assessment a license to process that content -- including sending it to our AI processing provider -- solely to run your interview, generate your report and development plan, and operate the features described on /privacy and /data-and-ai-processing.

6. AI-generated content

Your report, scores, and development plan are generated by an AI model based on your interview. Like any AI output, it can be wrong, incomplete, or miss context. It is not professional, legal, HR, or employment advice, and formal validation of the assessment is still in progress -- see /trust for exactly where that stands. Product Assessment is not currently intended to serve as the sole or primary basis for hiring, promotion, compensation, or termination decisions.

7. Fees

Individual assessments and manager team assessment are free while the product is in launch. Organization use is priced individually and is not processed through automatic recurring billing today -- see /pricing. These terms will be updated when a formal billing and refund policy is published.

8. Termination and account deletion

You may request deletion of your account and data at any time from your account settings or by submitting a request through the assessment’s data controls. We may suspend or terminate an account for violating the acceptable-use terms above. See /security for how deletion requests are currently handled.

9. Disclaimer of warranties

The service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any report, score, or output will be accurate, complete, or fit for any particular purpose, to the extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, BNG Holdings’ total liability arising out of or relating to these terms or your use of the service will not exceed the greater of one hundred dollars ($100) or the amount you paid BNG Holdings for the service in the twelve months preceding the event giving rise to the claim. BNG Holdings will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, even if advised of the possibility of such damages.

11. Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising from or relating to these terms or the service will be brought exclusively in the state or federal courts located in Kane County, Illinois, and you consent to personal jurisdiction there.

12. Changes to these terms

We may update these terms as the product changes. Material changes will be reflected on this page with an updated date.
